1. Introduction

Welcome to Te Pō ("we", "our", or "us"). These Terms and Conditions ("Terms") govern your use of our website and the purchase and use of our stargazing guide training courses and astronomy education services ("Services").

By accessing our website or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Services

Te Pō provides professional training for stargazing guides and astronomy education in New Zealand. Our Services include:

  • Full stargazing guide training courses
  • Individual training modules
  • Customized training programs
  • On-site and online training delivery

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice.

3. Booking and Payment

3.1 Booking Process

Course bookings are made through our website contact form or by direct email. All bookings are subject to availability and our acceptance. We reserve the right to refuse any booking at our discretion.

3.2 Pricing

All prices are displayed in New Zealand Dollars (NZD) and are subject to change without notice. Prices do not include GST unless otherwise stated. Final pricing will be confirmed upon booking confirmation.

3.3 Payment

Payment terms will be specified in your booking confirmation. We may require a deposit to secure your booking, with the balance due before the course commencement date. Payment methods accepted will be communicated during the booking process.

4. Cancellation and Refunds

4.1 Cancellation by You

If you need to cancel your booking, please contact us as soon as possible. Our cancellation policy is as follows:

  • More than 14 days before course start: Full refund minus a 10% administration fee
  • 7-14 days before course start: 50% refund
  • Less than 7 days before course start: No refund

Refunds will be processed within 14 business days of cancellation confirmation.

4.2 Cancellation by Us

We reserve the right to cancel or reschedule courses due to unforeseen circumstances, including but not limited to weather conditions (for outdoor activities), instructor unavailability, or insufficient enrollment. In such cases, we will offer:

  • A full refund, or
  • Transfer to an alternative course date (subject to availability)

We are not liable for any additional costs incurred as a result of cancellation.

5. Course Content and Materials

All course content, materials, and intellectual property remain the property of Te Pō. Course materials are provided for your personal use during and after the course. You may not:

  • Reproduce, distribute, or share course materials without permission
  • Use course materials for commercial purposes
  • Record or film course sessions without prior written consent

6. Participant Conduct

Participants are expected to:

  • Treat instructors and fellow participants with respect
  • Follow all safety instructions and guidelines
  • Arrive on time for scheduled sessions
  • Notify us in advance if unable to attend

We reserve the right to remove any participant who engages in disruptive, dangerous, or inappropriate behavior without refund.

7. Limitation of Liability

To the maximum extent permitted by New Zealand law:

  • Our Services are provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount paid for the specific Service
  • We are not responsible for loss or damage to personal property

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

8. Health and Safety

Some courses may involve outdoor activities. Participants are responsible for:

  • Ensuring they are physically capable of participating
  • Disclosing any medical conditions that may affect participation
  • Following all safety instructions provided
  • Bringing appropriate clothing and equipment as advised

We reserve the right to refuse participation if we reasonably believe it would pose a risk to the participant or others.

9. Intellectual Property

All content on our website, including text, graphics, logos, images, and course materials, is the property of Te Pō or its content suppliers and is protected by New Zealand and international copyright laws. You may not use, reproduce, or distribute any content without our prior written permission.

10. Privacy

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

11. Third-Party Services

Our website may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites. Your use of third-party services is at your own risk.
